Terms of Service

By accessing or using EnergyMo's website (energymo.ai), purchasing our products, downloading our mobile applications, or using any of our services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use our products and services. These Terms constitute a legally binding agreement between you and Lesmo LLC ("EnergyMo", "we", "us", or "our"). We may update these Terms from time to time, and your continued use of our services constitutes acceptance of any modifications.

"Products" refers to EnergyMo Ring and any accessories, sizing kits, charging equipment, and related physical goods. "Services" refers to the EnergyMo mobile application, website, cloud services, health insights, EnergyMo+ Membership, and any other digital services we provide. "Content" refers to all text, images, data, health metrics, insights, recommendations, and other materials available through our Services. "User", "you", or "your" refers to any individual who accesses or uses our Products or Services.

Unless we clearly state otherwise in writing for a specific product, SKU, packaging, or jurisdiction, EnergyMo Products are consumer wellness / lifestyle electronics. They are not sold or represented as medical devices requiring registration, clearance, or approval with the U.S. Food and Drug Administration (FDA) or equivalent regulators, and they are not intended for use in the diagnosis, treatment, mitigation, or prevention of disease in a clinical setting. By purchasing or using our Products, you acknowledge that: (i) they are for personal wellness and general fitness awareness only; (ii) marketing, packaging, and in-app descriptions do not create a doctor–patient relationship; (iii) you will not rely on Products or Services as a substitute for professional medical judgment; and (iv) regulatory labeling and product classification may differ by region and may be updated from time to time. If a particular offering is authorized or marketed as a medical device in your country, that status will be disclosed on the applicable product page, checkout flow, or regulatory labeling. In all other cases, the wellness-only classification above applies.

To use certain features of our Services, you must create an EnergyMo account. You agree to: • Provide accurate, current, and complete information during registration • Maintain and promptly update your account information • Keep your password secure and confidential • Not share your account credentials with any third party • Notify us immediately of any unauthorized use of your account • Be responsible for all activities that occur under your account We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.

All purchases through our website are subject to the following terms: • Order Acceptance: Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order for any reason, including product availability, pricing errors, or suspected fraud. • Order Confirmation: An order is confirmed only when we send you an order confirmation email with a unique order number. Until then, no binding contract exists. • Product Availability: All products are subject to availability. We make reasonable efforts to maintain accurate inventory, but cannot guarantee that a specific item will be in stock at the time of your order. • Order Limitations: We may limit quantities per order or per customer at our discretion. • Order Cancellation: You may cancel an unshipped order by contacting our support team. Once an order has shipped, it is subject to our return policy.

• Currency: All prices are displayed in the currency applicable to your selected region and include applicable taxes unless otherwise stated. • Price Changes: We reserve the right to change prices at any time without prior notice. Price changes do not affect orders that have already been confirmed. • Payment Methods: Payments are offered through Stripe. Available options depend on your region (for example Link, Klarna, or other supported wallets and local methods). • Payment Processing: All payments are processed securely by Stripe (PCI-DSS compliant). We do not store your full credit card information on our servers. • Sales Tax & VAT: Applicable sales tax, VAT, or other duties are calculated based on your shipping address and are displayed during checkout. • Promotional Offers: Discount codes, promotional pricing, and special offers are subject to specific terms and expiration dates. They cannot be combined unless explicitly stated.

Processing and delivery time: Orders are prepared in 1-2 business days and normally spend 5-7 business days in transit, for an estimated total of 6-9 business days. Remote areas, customs inspections, public holidays, and carrier disruptions may add time. Customs, duties, and tracking: Orders ship from Beijing, China with tracking. Unless checkout explicitly states otherwise, delivery is DAP/DDU: the recipient is responsible for import duties, taxes, brokerage, or customs charges assessed by the destination country. These charges are not included in product or shipping prices. Standard tracked shipping rates: United States: USD 39; free over USD 597. Canada: CAD 49; free over CAD 825. EU markets: EUR 39; free over EUR 550. United Kingdom: GBP 35/475. Switzerland: CHF 39/525. Norway: NOK 450/6,000. Denmark: DKK 300/4,100. Australia: AUD 59/920. Japan: JPY 5,500/90,000. South Korea: KRW 45,000/830,000. Singapore: SGD 49/800. Malaysia: MYR 159/2,500. Hong Kong: HKD 299/4,650. Taiwan: TWD 1,200/18,500. Saudi Arabia: SAR 149/2,250. United Arab Emirates: AED 149/2,200. The second amount is the free-shipping threshold. Order tracking: A tracking number is emailed after dispatch and is also available on the Track Order page. Eligibility and return windows: For change-of-mind returns, customers in the European Union and United Kingdom may notify us within 14 days of delivery. Customers in South Korea and Taiwan may notify us within 7 days of delivery. In other markets, change-of-mind returns are not accepted unless required by local law. These limits do not restrict statutory rights for products that are defective, damaged in transit, or not as described. Returned products must be handled only as reasonably necessary to inspect them and must include the original accessories and packaging where possible. Return process and shipping: Email [email protected] with your order number, delivery country, and reason for return before sending a product back. We will provide return instructions and the authorized return address in China. Customers pay return shipping for an eligible change-of-mind return. EnergyMo pays reasonable return shipping for a confirmed defect, shipping damage, or fulfillment error. Do not send a return without authorization. Refunds: After the authorized return is received and inspected, we process an approved refund to the original payment method within 2 business days. Your bank or payment provider may need additional time to post it. Standard outbound delivery charges are refunded where required by law; expedited delivery charges, import duties, and taxes are not refundable by EnergyMo unless required by law or caused by our error. Exchanges: We do not offer direct exchanges. For an eligible return, complete the return and place a new order for the preferred model, color, or size. This policy does not exclude any remedy required by applicable consumer law.

IMPORTANT: Please read this section carefully. • Wellness Purpose Only: EnergyMo Ring and related Services are designed for general wellness and fitness purposes only. They are NOT medical devices and are not intended to diagnose, treat, cure, or prevent any disease or medical condition. • Consumer Product Classification: Our physical products are offered as general consumer wellness electronics unless we expressly identify a specific item or region as having a different regulatory status. Do not use them as medical or clinical monitoring equipment. • Not Medical Advice: The health insights, scores, recommendations, and data provided by EnergyMo are for informational purposes only and should not be considered medical advice. Always consult a qualified healthcare professional for medical concerns. • Individual Variation: Health metrics and insights may vary in accuracy based on individual physiology, ring fit, skin type, activity level, and environmental conditions. • Emergency Situations: Do not rely on EnergyMo products in emergency medical situations. Always call emergency services (911 or your local equivalent) for medical emergencies. • Proper Use: Use the EnergyMo Ring as directed in the user guide. Improper use may affect accuracy and could damage the device. • Allergies: The ring is made from hypoallergenic, low-irritant materials. If you experience any skin irritation, discontinue use and consult a healthcare professional.

• Coverage: EnergyMo Ring is covered by a 1-year limited warranty from the date of original purchase, covering defects in materials and workmanship under normal use. • What's Covered: Manufacturing defects, battery failures (below 80% capacity within warranty period), sensor malfunctions, and premature wear under normal use conditions. • What's Not Covered: Physical damage from drops, impacts, or crushing; damage from use beyond the rated water resistance depth (100m); cosmetic damage (scratches, dents) from normal wear; damage caused by unauthorized modifications or repairs; damage from misuse or failure to follow product guidelines. • Warranty Claims: To make a warranty claim, contact [email protected] with your proof of purchase and description of the issue. We may request photos or the return of the product for inspection. • Remedies: At our discretion, we will repair, replace, or refund the defective product. Replacement products may be new or refurbished with equivalent functionality.

All content, features, and functionality of EnergyMo products and services — including but not limited to software, algorithms, text, graphics, logos, trademarks, images, audio, video, data compilations, and the overall design and layout — are the exclusive property of Lesmo LLC and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use our products and services for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, decompile, or create derivative works based on our products or services without our prior written consent.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW: • EnergyMo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, health outcomes, goodwill, or other intangible losses. • Our total aggregate liability for any claims arising from or related to these Terms or your use of our products and services shall not exceed the amount you paid to EnergyMo in the twelve (12) months preceding the event giving rise to the claim. • We do not guarantee uninterrupted, secure, or error-free operation of our products or services. • These limitations apply regardless of the theory of liability (contract, tort, strict liability, or otherwise) and even if EnergyMo has been advised of the possibility of such damages.

You agree to indemnify, defend, and hold harmless Lesmo LLC, its officers, directors, employees, agents, licensors, and suppliers from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms, your use of our products or services, or your violation of any rights of a third party.

• By You: You may terminate your agreement with us at any time by closing your account and ceasing use of our products and services. • By Us: We may suspend or terminate your account and access to our services at any time, with or without notice, if we believe you have violated these Terms, engaged in fraudulent activity, or for any other reason at our sole discretion. • Effect of Termination: Upon termination, your right to use our services ceases immediately. We may delete your account data after a reasonable retention period, subject to legal requirements. Any provisions of these Terms that by their nature should survive termination will survive.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or our products and services shall first be attempted to be resolved through good-faith negotiations. If unresolved within 30 days, the dispute shall be submitted to binding arbitration under the rules of the American Arbitration Association (AAA) in Wilmington, Delaware. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action. If for any reason a claim proceeds in court rather than arbitration, you waive any right to a jury trial.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you by email, through the EnergyMo App, or by posting a notice on our website at least 30 days before the changes take effect. Your continued use of our products and services after the effective date of the revised Terms constitutes your acceptance of the changes. If you do not agree to the new Terms, you must stop using our products and services.
